Expose CAS Ontario Advocates attended the London Ontario Court House at 80 Dundas street to address the warrant in the picture below for this one mother that we are involved with. This mother herself inquired as to whether or not her infants warrant was legal at the time of apprehension she was shocked to find out it was not legal it turns out that the Society's warrant did not become legal until 5 days after the society had actually apprehended her infant baby therefore those 1st 5 days the society had her baby in care was illegal and that child had been kidnapped! The Ontario Children's Aid Society apparently does this to everyone according to the court cleark at the court house in London Ontario!

The discovery of fake warrants & how far the London CAS goes as well as all other Ontario Children's Aid Society's to steal children and cover things up explains why in the past year 23,300 kids have been illegally stolen and taken into care! It has to stop now!

This is the recording where the London Ontario Court House at 80 Dundas street confirms that London and Middlesex Childrens Aid Society uses fake warrants to apprehend all the kids they apprehend & the only way to find out if they are legal is if the society files them with the protection application at the 5 day hearing in this case they did file this particular warrant at the 5 day hearing after already having the child in care for 5 days (the warrants to apprehend the kids) they do this in hopes that no one is smart enough to look back and say what the hell!!

You had no legal reason to apprehend my kids on the day you did & filing warrants 5 days later just to try and "make the numbers look good because of your funding is ridiculous I want my kids back now" coming soon will be more recordings from more people who are doing this as well.......

Let's see which warrants ended up filed & which ones didn't end up filed but the point is on the date of those warrants the society did NOT have an exparte motion at the court house to obtain those warrants the cleark flat out says on here like: "THE SOCIETY PRINTS OFF THESE PAPERS FROM THEIR OWN COMPUTERS AND THEY FILL IT OUT THEMSELVES, CAS HAS THEIR OWN ARRANGEMENTS FOR THOSE JUDGES TO SIGN THEM, I GUESS....."

According to the CFSA The Children's Aid Society has a mandate they are required to follow they were recently given the eligibility requirements for 2016 if workers would follow that then there would be less kids in care It's been reported that 23,300 children have been put into the foster care system over the past year in Ontario alone! Well doesn't this explain why? When you allow an agency with no accountability to have free range over government money & you tell them that you will give them all the money & power in the world just as long as they keep stealing kids and selling them to rich people & keep the trouble makers away then yeah you're damn right that's what their going to do but will the good parents go away never to be heard from again?

Not without their children CAS! You can bet on that one! You can't get rid of us good loving parents until we reclaim our children they are rightfully ours after all & you did steal them!! Families are encouraged to take copies of your warrants no matter how old they are go to the court house they claim to be issued from record & don't tell them your recording & bring photo ID and have your child protection file checked & ask these questions:

1: On the date that is listed on the warrant The date of apprehension did the society attend the court house for an exparte motion & meet with the judge who signed that warrant an exparte motion will be listed in their computer system & in your file

2: On your 5 day hearing what exactly was filled on that date was it only the Societies material - the protection application the temporary order for 30 days - were there any warrants filed from the date of apprehension - this is important because as of right now still no warrants are filed then your kids were illegally apprehended!

The courts were lied to & you have an emergency change in circumstances to immediately return the kids! If the warrants were filled on the 5 day hearing you just proved that for 5 days CAS had your kids illegally & the judge only made a decision because he only had CAS'S information in front of him so that's all he had to go on! Which again is another set up by CAS & it isn't fair it's CAS stacking the deck in their favor and that's not right!!

Yesterday at an Expose CAS Ontario Support Group Meeting members of our group got together and compared apprehension warrants for our children over several years and we're not at all surprised to see a lot of similar problems with the warrants like:

no court file numbers on "warrants that... access page ...

no court file numbers on "warrants that the London society supposedly had exparte motions to obtain which would mean that a court file number would have been generated for the warrants"

1 warrant signed on November 14th 2012 by justice of the peace Kristene Diaz has a "stamp" on it but 2 other warrants by 2 more JPS in 2016 & 2011 do not have those same JP stamps

The children in the 2011 warrants were apprehended on March 17th 2011 not May 31st 2011 as the warrants state which raises questions about these warrants & the urgency of the warrants

The child involved in the 2016 Warrant was taken from the hospital at birth by an intake worker with a poorly done version of this fake warrant that was executed right after she gave birth not even following the CFSA & the child protection mandate as legally outlined by the province which is so wrong on so many levels it's their 1st and foremost mandate to keep families together and this is the poster story of not doing that and then some! You just don't rip apart a family with out giving them a chance 1st it's wrong! No family deserves it!

All these families have been to the court house in London and confirmed that these warrants are not part of their court files either which also means that if something is not part of your court file then it is not legal either because we all know that everything that happens in CAS court with our kids exparte court or not it still gets added to the court file so we can all at some point access it from the court file & at anytime anyone who is listed as a party on the court file can go to the court house & show id & ask for your own court file and see what's in it and copy anything that you don't have because CAS files stuff all the time without telling everyone about it!

On a personal note in early 2008 I found out that CAS tried to get 3 apprehension warrants 3 separate times on 2 of my kids and that 3 different JPS turned them down and put on the court file that they felt the "society was acting vindictive towards me and my family in January and February 2008" this was when they started to come after me back then! That information was in the court file along with the warrants that were denied the affidavits & exparte motions ultimately the society took the kids illegally in order to win but they still tried legally 1st but we're denied & obviously for good reasons! So please pay attention to the documents that they are giving you. You can even call the court house if CAS shows up with 1 of these warrants & verify that it's actually real if it's not don't hand your child over to them! It's time to change the way things are & in order to do that we need to know how many more people have been targeted with these fake warrants!

If anyone else has warrants that looks like these we want to know please come forward we want to help you we are gathering people who have this proof so we can do something about it get in touch with Expose CAS Ontario ASAP!

I am allowed to post this they are verifed already to be illegal warrants they have not been issued by the judges that signed them these judges signed these warrants but didn't actually issue them directly to the named children and families that are listed on these warrants which is a direct violation of section 40 & section 51 of the CFSA when apprehending with a warrant the court house has no record of these judges having any of these hearings on these dates

Even worse the 2011 warrants for the "Gomes children" they were apprehended on March 17th 2011 the date of the warrants are May 31st 2011 how is it possible that the worker Marina Antic was able to abtain an apprehension warrant for 2 children on May 31st 2011 how ever she showed up at the grandparents home on March 17th 2011 with a "peice of paper" that she claimed at that time was a warrant but she refused to show it to the grandmother and give her a copy of it. The grandmother did not get this document until 6 months ago when her lawyer threatened her new CAS worker over it the warrants produced were these posted in the pictures that are dated "May 31st 2011" so how did Marina Antic a child protection worker show up on March 17th 2011 with a "warrant" & apprehended 2 children if the warrant wasn't dated until May 31st 2011??

I only post stuff with people's permission & if we can find a few more people than we have a soild enough case to go to a civil lawyer & sue CAS over & Lizzy I think we're good when it comes to knowing what we can & can't say & do so I don't need you telling me what I'm allowed to do & what I'm not allowed to do I don't even know you but it's kind of annoying to have to tell you that again!

Helpful information about Section 51 [94] of the CFSA act - Family Court

Mr. Beck from Canada Court watch provided some helpful information about Section 51 of the CFSA act in Ontario which some parents will find helpful. Family Court / Child Protection matters adjournments cannot be for more than 30 days without consent of the parties.

A long adjournment will give child protection workers more time to harass the family and to dig up more information on the family which will be used against them at the next court appearance.

(It is now section 94 not 51 under the new legislation but the same aspect applies just the section number has changed) akPATsy April 2018

Child and Family Services Act (Ontario)
Part 111 – Child Protection - Hearings and Orders

Analysis of Clause 51.(1) Clause 51.(1) (a) & (b) states the following:
Adjournments

51.(1) The court shall not adjourn a hearing for more than thirty days,
(a) unless all the parties present and the person who will be caring for the child during the
adjournment consent; or (b) if the court is aware that a party who is not present at the hearing objects to the longer adjournment. R.S.O. 1990, c. C.11, s. 51 (1).

(Date: March 18, 2016) Analysis and review of the Legislation

Clause 51.(1) (a) & (b) of the Act are fairly clear in their wording and do provide some important protection for parents who have had a child apprehended into care or the subject of a Court imposed supervision order for a CAS agency, especially under short notice or an apprehension of a child without prior notice.

Under the Act, an adjournment in a child protection court hearing cannot be adjourned for more than 30 days unless ALL parties in the court and the person who will be caring for the child consent to an adjournment for more than the 30 days. The use of the word, “shall” in the legislation indicates that neither the court nor a CAS agency have the discretion to adjourn a child protection matter for more than 30 days without clear informed consent from all of the parties.

This section is frequently ignored by child protection workers and their lawyers as most parents are unaware of this specific section of the Child and Family Services Act. . Parents who are unaware of this clause in the Act may be led to believe that they have no other choice except to agree to whatever adjournment is requested by the child protection agency lawyers. In many cases just before the hearing parents are presented a consent order for them to agree to. Many parents feel pressured to sign these consent orders before the actual court hearing.

In many cases, legal aid lawyers and/or duty counsel lawyers will tell their clients to just go along with what child protection lawyers want. In general duty counsel lawyers and legal aid lawyer just want to collect their money and to do the least amount of work.

In many cases, the child protection workers want to delay the next court hearing as long as possible for the following reasons:

More time for workers to harass and to build evidence to use against the family A long adjournment will give child protection workers more time to harass the family and to dig up more information on the family which will be used against them at the next court appearance. It is common that once the child rotection agency obtains a court order at the first court appearance and an adjournment is obtained, child protection workers will instead of helping the family, make it their primary goal to build a stronger case to support the case of the child protection agency. In many cases false information will be fabricated by child protection workers as they work hard to support the agency and not the parents.

More funding for the child protection agency and its workers The longer that a child protection case file is open and/or a child placed into foster care, the more provincial money that the agency, its workers and its lawyers will obtain from the taxpayers. Workers get to keep their jobs as well. Below is an article rom the media about the Peel Children’s Aid Society keeping files open to maintain funding.

More time for child protection workers to establish a new “status quo” for children taken into care

The longer a child has been taken into care, the more time will the child protection agency have to establish a new “status quo” for the child who has been taken into care. At the next court appearance the child protection workers will often report that the child who is in foster care had adjusted very well to foster care and is very happy to be in foster care. Of course, these are the standard lies that CAS workers use to justify their jobs and having apprehended a child. After telling the court that the child loves his/her new foster home, the child protection workers will then recommend that the child stay even longer in care. Everyone in the system keeps making more money!

The longer a child remains in care the more difficult it is for the parents to get their child back home after a status quo has been established. It is not uncommon for CAS lawyers at the first court hearing to ask for adjournments longer than 30 days.

Adjournments can be longer than 30 days but ONLY with the consent of the parties It is not uncommon for CAS lawyers to pressure parents just before a court hearing to get them to sign a consent agreement which contains certain terms and conditions. The lawyers know that the parents are under the most pressure at their first court appearance, especially if the parents were served court documents just before the court. During these conferences just before court, the CAS agency may try to get parents to sign a consent agreeing to a longer adjournment time than the 30 days as required under legislation.
To prevent an adjournment from being more than 30 days, all that parents have to do is to quote section 51.(1) of the Act to the judge. This is the law and the judge cannot, and should not, make an order which is in violation to the law in Ontario. Parents who have had their child apprehended should
ensure that they mount an effective defence and return to court and be ready to defend themselves as soon as possible within the 30 days and be vigilant not to consent to adjournments longer than 30 days without very good reasons for doing so.

Don’t let your lawyer pressure you into an adjournment if you don’t want it Don’t forget that in many cases, legal aid lawyers and/or duty counsel lawyers will tell their clients to just go along with what child protection lawyers want. In general duty counsel lawyers and legal aid lawyer just want to collect their money and to do the least amount of work. If you have a lawyer and do not want an adjournment longer than 30 days then make sure that your lawyer brings this up before the court and quotes this section of the CFSA.

Can anyone tell me how to report a CAS (facs where I live) for lying & deliberately misleading the court? Yesterday a Facs worker lied in court right iin front of me after just speaking with me about what she lied about to the judge. Please help, they've beaten me enough, its time for some payback

I figured out that the way to proceed is first tell your lawyer that you wish to file purgury charges against the Facs worker. He or she will tell you that you can't. But they are lying to protect the system. Your next step is take your evidence that it was a lie to floor 3 of the St catharines courthouse to the crowns office. Knock on the door & say you wish to file formal purgury charges against said Facs worker & do everything the crown says

I wasn't expecting a sworn court officer & a sworn member of the public sector to lie. But I paid them back at least. Got the worker charged & she had to take a leave. She plead guilty last week so now she can never again work for or with children
