Looking for assistance. I have been living in the US for the past 10 yrs, since my ex move the kids from Ontario to New Brunswick. In that time time I have never once missed child support payments, last yes but never not paid it. I have two girls 26 and 21 yrs old. The 21 yr old is in university and I understand that child support is still to be paid. However I have found out that 1) The ex has purchase a ONE bedroom home therefore there is no place for the 21 yr old to stay when she returns from university. 2) My 21 yr old has set up a new address at another location where she helps pay for rent and utilities when she comes home from University.


I have no issue paying child support providing it is being used to assist in supporting the child, however in this case she is not getting any financial support at al. What I would like to be able to do is find a way to stop pay the ex child support, especially since my daughter no longer has residence and pay my daughter directly till she completes her university education. At least this way she won't have to struggle as much.


Can someone please let me know what can be done. Greatly appreciate it.

It sounds like in this case the doctor determined the potential for damage out weighed the potential for good. He or she maybe wrong on that, especially if the doctor was missing info but the judge will resepect a fellow proffessionaly experts opinion. If you feel the doctor was wrong, ask the judge to re issue the order with a detailed list of the reasons that you feel the doctor did not know. It will still be the primary care doctors opinion that matters in the end.

30 years ago I was removed from my abusive mother Lorrainne Maich and placed in foster care.During that time I experienced more physical abuse at the hands of my foster brother Robbie Scott as well as exposure to sexual abuse as I watched him repeatedly sexually assault their family friend living at the home, as my foster mom Dale Scott turned a blind eye and a horrible CAS worker's named Bev Burman, and Lionel Muir who also was very aware of the abuse but left me at this home for 3 years. I weighed 80lbs at 14, my bones stuck out like an Auschwitz concentration camp survivor by the time a new CAS worker Leanne Murray removed me from what the CAS deemed a safe environment.I was fortunate enough that Leanne placed me in an amazing home with 2 foster parents that loved me and my foster mom had earned my trust and showed me how a parent loves a child in every positive way! That home was taken from me when Bev Burman returned as my worker and I was placed in a group home McNeil house in Oshawa.

In March I applied for my own CAS file, today I received a phone call it is ready to be sent to me.I opted for it to be emailed. There are no words to explain the anxiety,fear,happiness and the 100 other feelings I have waiting for this email. The fear of reading the tramatic abuse I was repeatedly subjected to is terrifying and opening up wounds or scars has me in tears. This is part of the reason I was diagnosed with PTSD from before birth to the day I was tossed away by CAS a VERY long painful history of child abuse in all forms. I have worked hard getting through my PTSD with classes, self study and therapy and feeling healthy, moving forward and ultimately realizing that it was not my fault that I was a child who was abused at the hands of several adults that from birth were supposed to protect me, my parents and the CAS. I could write a novel and several sequels pertaining to the abuse I endured with gasping effects and horrific details.

For those of us that were crown wards and felt the pain, today is about validation for me.My life is on paper and as hard as it will be to read maybe closure will happen but I highly doubt that as the accountability will never be given by my mother, Robbie Scott died and the Society historically has been rarely in held accountable. The term SOLICE comes to mind  definition:the comfort or consolation in a time of distress or sadness. The courage that it take to finally decide to obtain the painful past and find the strength to read it and know enough to put it down IF it becomes too much has/will be upon every one of us that's endured this road with the damage it caused.And as alone as we fell we actually aren't. There are thousands of us that grew up with the belt, punched, sexually assaulted, starved of food etc and at a time of Society removal only to be placed back in that prison has made us feel unwanted, ashamed ,alone,worthless,shuffled and empty.

Once I get my file and read it...... cry........find strength..... it will be shared online with the hope that survivors will know your not alone in this and to continue to show the 100 years of child abuse the Society has knowingly hidden for the lives taken by them and the millions of dollars as incentive to continue to keep their dirty secrets!

A North Shore social services office is in lockdown over fears of a father embroiled in a child-custody battle.

A Crown prosecutor Tuesday outlined measures taken by Secwepemc Child & Family Services to protect staff from Frederick Philip Shupe.

All of them are expressing a real fear of Mr. Shupe,” said Crown lawyer Neil Flanagan. “I’ve been told the Sydney Avenue office is now in lockdown . . . . Workers are afraid of him.”

Shupe, 45, was convicted after trial on two counts of uttering threats. In the first instance he left a message on a social worker’s voicemail stating “he will haunt her until she dies,” Flanagan said.

In the second instance, he confided to a probation officer that he wanted to tie up social workers, hold them hostage and set traps for police when they come to free them.

Shupe is awaiting sentencing on the convictions. As part of his bail conditions, the Crown sought to keep him away from social workers, making his only contact through a lawyer.

His lawyer, Don Campbell, said Shupe doesn’t want contact with Secwepemc Child & Family Services and would like the file transferred to another First Nations social agency in the city.

“He’s forced to go there because his children are in their care. Secwepemc Child & Family Services holds the key to any contact with his children.”

Shupe is involved in a separate family court proceeding regarding contact with his children.

Campbell said the agency “doesn’t want anything to do with him but they cling tenaciously to his file.”

Judge Edmond de Walle ruled that as part of bail conditions that Shupe have no direct or indirect contact with staff or family from the agency and he is banned from being within 100 metres of its offices.

He will be sentenced on the charges of uttering threats at a later date.

Russ McNeill When I had to deal with Social Services, I had a lawyer involved. My lawyer made it clear that they could not contact me directly, nor could they interview the kids without notice. They also had to take the issue to court if they wanted to take action of any sort. This stopped them dead in their tracks, since they did not have any grounds to take action in the first place, and they were acting in bad faith.


H Chris Ericksen So if they can't interview kids without notice why do social workers often go to schools or daycares to interview children without parental knowledge? Is that against policy?


Russ McNeill If they know you have a lawyer and are case managed they seem to follow the law for fear they will get caught overstepping their bounds as they tried in my case. They also found that when u said I would do something, I would do it. I do not make idle threats, and I know the laws better than they do. That us how you must deal with them. I recorded every interaction with them, and they only found out after they were caught in lies. I would follow up this with a letter to the minister cc'd to numerous others both in the media and the government. They were then under scrutiny. They assigned a senior agent to my case as a result, and it solved all the games they and my ex tried. When they wanted to intervene in my home, u asked what they were doing with my ex to understand where the problems were. Initially they tried to claim they only deal with the custodial parent which was me, I asked where it said that in their laws. At that point they started to look at my ex, and when she refused to work with them as i was, it made it clear that she was using them to try to cause problems with my custody. When social services finally understood this, things drastically changed. This was confirmed when she made more allegations and I was able to point out flaws in the complaints. They stopped taking complaints from her, and then started to investigate new complaints and found these were made by her friends, and that pretty much ended my dealings with them. It was a year and a but if hell, but we survived intact.


H Chris Ericksen I have never had cps involvement, but I know that they will do that without alerting the parents, what I don't know is if they are supposed to be doing that or not?


Russ McNeill They can make an initial interview but once they know lawyers and the courts are invovled they should stop. But it depends on the nature of the complaint. In my case and in many other divorce cases they get dragged into it as an extra way for the other side to cause problems. Once they realize that that is what is happening, they usually change how they act. Not all social services workers are bad. There is a reason why we have that agency, and they often deal with some pretty ugly situations, and their main priority us to protect children. Unfortunately they often are biased and jump to conclusion as they initially did in my case. I had good advice from my lawyer, and she had me hire a lawyer to deal with Social services specifically as it is a very special kind of law and manner to deal with. I also am not someone who is easily intimidated, and I am well versed law. That is largely what helped me weather that storm.

September 01 2014 To Whom it may Concern, I have been a party to Ontario Court of Justice Family court since July 18 2013.

I have been before the Hon Justice G Edwards and Justice Madame K Baker.

My matters have been “conflicted” since December 06 2013 when Hon Judge Edwards ordered me to do a drug test[Superior Court Appeal with Ontario Court of Justice December 27 2013].

While I was in court on our last date on August 19 2014 I attended court at 44 Queen St at or around 951am to set a Trial Sitting Date. 

When I arrive I discover that Trial Management Conference had again been scheduled and I again had not been served. I was in court August 18 2014 and there was no mention of August 19 2014. I showed up anyway August 19 2014 and was refused to file my Trial Management Brief.

I see Case Event List **attached. I enter Court Services office , I am followed by a lawyer named Richie (?) and unknown CAS lawyer. 

Court Clerk Dianne MacNeil hands me an endorsement from Justice K Baker dated August 19 2014. Endorsement indicates not only was I in court but I also had counsel. 

[This would be the fifth instance I have had a lawyer without my knowledge.

May 15 2014, July 04 2014,July 16 2014,July 29 2014,August 18 2014,and August 19 2014] 
When I originally entered courtoom August 19 2014 at 949am everyone was silent. 

Ontario Childrens Laywer D Partridge and the lawyer named Richie and Laywer on Record for CAS V Kalieste are seated, however no other party is seated opposite – Laywer Richie tells me “Court is Closed” I must leave ;

I do. I sign up for Duty Counsel ; 

I am told she cannot help me because of drug charges ; I ask her to clarify – she leaves goes back into Courtroom 3 says “talk to clerk”.
I sense something is wrong , I enter Court Services office again. 

I request Audio Transcript for August 19 2014. I am given a stamped copy of  my request for “a hearing I have never been in”.

I notice a letter from Judge Edwards to me dated today August 19 2014 to come to Courtroom 5 on August 25 2014 **attached. 

This letter has been forwarded to Attorney General Ontario [August 22 2014 file number #MC20144075].

When I arrive at court on August 25 2014 , I immediately take possession of Case Event Public List dated August 25 2014*** attached.

I am also attaching Case Event Public List [1 page] dated August 19 2014. I attended Courtroom 5 for Judge Edwards matter first. Without my consent , he orders that Brantford Police File Disclosure which was ordered disclosed February 20 2014. I ask the Judge “why am I here ? what is this ? he says we are having a talk”.

Judge Edwards was made aware I had to give “confidential” information [which I was told by Brantford Police K Reeder and R Saini would never be made public.] regarding Applicant Trafficking activities by means of electronic mail,sms text messages,etc. 

Judge G Edwards changed the order to have the records released - to the very same convicted drug trafficker [Ronald Pacheco] the Police records are/is about among other known associates of the Applicant. Further to that; I also believe an Order was “back dated” to March 13 2014, to allow Applicant to “change address” again and to now have this man listed as a CAS verified “support” and CAS is helping to facilitate R Pachecos adoption of my son ; 

while matters are CURRENTLY BEFORE court – because the Applicant was institiutionalized after July 23 2014.

All orders after July 04 2014 are without my consent,knowledge or having been served. 

I have never approved to form any orders ; I have sent numerous orders for approval – I have yet to receive a response.Further to that I believe Judge Edwards intiated motions with Family Responsibility Ontario [on dates I was scheduled for court August 18 and 19 and 25 of 2014, but had not been served notice or documents and was never paged] in attempt to have me jailed for back child support I didn’t even know about]. 

I did hear “Anyone with matters in Courtroom 3 please come now” but my name was never called. 

The Attorney General of Ontario was forwarded an email I sent ; regarding Judge Edwards and how he had removed the first, of the many CAS attempts at “Child Protection Hearings” from the Continuing Record and there was “no order for removal”.[FLR 9 [13]or[4]].

I am also unaware of any Family Responsibilty Ontario motions,but any motions put before Judge Edwards with FRO inside the month of August are most certainly centered around 246/13 and I haven’t seen my sons in almost a year ;

I have brought this to Judge Edwards and Judge Bakers attention on more than one occasion when I asked them “Where are my children?” August 18 2014 Mme Justice Baker and “What if they are already dead?” Justice G Edwards on August 25 2014. On September 9 2014 I believe I will be thrown in jail for something I have never been informed of, never had any input and will now most certainly face serious consequences if incarcerated seeing as I will not be offered “protective custody”.

I do not understand why this was necessary.

I am now recieving Death Threats with anonymous people”quoting comments,msgs things I have said to Brantford Police that I was personally told “that no one will ever find out” as result; of this man Judge Edwards actions - the exact opposite is now going to happen.

I fear an Inquiry will be necessary regarding conduct,ethics and governing practices that have been all but ignored; however I fear by the time anything can be done; it will be too late on too many levels. 

I would request something be done so I can see my son before I am killed or harmed for trying to protect my children from this very thing happening. 

I was told I required “leave” to file any further motions; this would explain haste – seeing as I believe there has already been an “uncontested trail” without my knowledge.

I would ask the Judicial Council only investigate after the September 9 2014 as then I will know whether or not ; my assumptions are correct. 

I have prepared a motion which I will attempt filing and an affidavit I am faxing you that after you have received this letter.

They are signed and dated for September 01 2014 I will be attaching as well.

I have always done what I believed” to be in the best interests of my children” it is said “ men that intervene when the law cannot ; are the men who have the highest respect for that said law” I was repaid by the Ontario Court of Justice with my blood.

This is Justice ? or even Logic ? 

I will forward along this letter as well as all attachments to Attorney General again. There is something wrong here ; “badges of fraud” are rampant.

I will attach appendix of attached documents.my greatest fear is that by the time this is addressed it will be too late.

Lawyers don't provide rights.. you have rights, learn how to enforce them. A Lawyer can only represent the rights of your legal person, which are completely different rights than those you actually have as a natural being. The only court case I have ever lost was when I made the mistake of hiring... access page ...

The only court case I have ever lost was when I made the mistake of hiring a lawyer. Since then I became quite comfortable filing my own paperwork for claims, or for defence. 

Once you realize that a BAR attorney has an oath to the crown that is superior to his oath to represent his client, you start to see the scam they want to push you into.. Hiring a lawyer tells the courts you are incompetent and unfit to represent yourself.. So just keep paying!
