Just wondering about experiences in filing contempt.
Brief story: Divorced 8y, 2/3 kids live with me. Just got a new c/o last spring. It specifically says all scheduling changes happen 48hr before exchange & no trash talking parents to kids...we spearheaded this new c/o, these are 2 ongoing issues. This holiday, as per bm's schedule we are supposed to get kids on the 27, she asks to meet 28, we agree. She goes back & forth on time. 5pm on the 27 she changes the time to "the original plan" we say "today????" It will take us 1hr driving to get to the exchange spot. She says yes, be there or don't get your kids via text. (This is sm writing) dad is out, left his phone at home. I can't meet her or get hold of dad. I hesitate to respond (10m) because I try to stay out but obviously I have to say something. So I tell her I can't get hold of dad & I can't meet her.


She has a child call, from the car, on speaker. When I answer then chitchat w/SS she jumps on & when I reiterate that I responded via email that we can't make it there with such short notice she says on speaker "il just tell the kids you can't be bothered to come pick them up then" before I could ask if she could drop them or even say that's not what I said. She hung up.


Lawyer has filed contempt a couple times over the past few months. My question is for people who've filed contempt...where's the line? Is this too petty? I think it's shitty we tried to accommodate her last minute changes & she still tried to f us over. I wonder if a judge would think this was a waste of his time. This is clearly a time she implied something bad about dad in front of the kids. I just don't know if it's enough for a judge to take seriously. Please give me your experiences with filing contempt.
