If she has choice of residence and it hasn’t placed restrictions then yes she can do whatever she wants. You can however make an application to the court to have a restriction added and I don’t think they would say it’s okay for her to move three hours away unless she agreed to do the driving involved

   

File an emergency order with the courts. Unless she can prove that she has to move because she CANNOT get a job in the current area then you can stop your kids from moving. I have seen friends try to do move with their kids without permission from the dad, and the judge made the mom leave the kids behind if she decided to go ahead with the move when she could not prove that she HAD to move. Do it now BEFORE they move.

   

No she can't just move. ESPECIALLY if you have a court order specifying access schedules.

If you have a court order already, it's shocking that restrictions to moving aren't in there already. It's one of the top three "dirty tricks " played by singlemommies©

To be done properly, she would have to get the court order altered. She would have to show how the move is in the best interest of the children. Which it won't be.

It's not a slam dunk for you, but she will have an uphill battle.
